    Introduction

    This Acceptable Use Policy (“AUP”) governs the use of all hosting, server, domain, network, email, reseller, software, and related services provided under the APNCloud brand. It is designed to protect customers, end users, third parties, APNCloud infrastructure, upstream providers, and the wider internet from unlawful, abusive, insecure, or disruptive activity.

    This AUP forms part of the APNCloud Terms of Service. By purchasing, accessing, using, reselling, or permitting another person to use an APNCloud service, you agree to comply with this AUP and to ensure that anyone using the service through your account also complies with it. If you operate Reseller Hosting or provide access to your own customers, you remain responsible for enforcing standards that are at least as protective as this AUP.

    The examples in this AUP are not exhaustive. An activity may still be prohibited if it creates a material security, legal, operational, reputational, or network risk even when it is not specifically listed below. APNCloud will apply this policy reasonably, taking account of the nature, seriousness, intent, impact, and history of the activity.

    1. Scope and Responsibility

    This AUP applies to all APNCloud services, including Shared Hosting, Reseller Hosting, Cloud VPS Hosting, Managed Cloud VPS Hosting, Dedicated Servers, domain-related services, DNS, SSL, email services, software or license products, backup services, and any other service that uses or connects to APNCloud systems or infrastructure.

    You are responsible for all activity conducted through your account, service, server, website, domain, mailbox, application, API key, control panel, reseller account, or credentials, except to the extent an incident is caused by APNCloud and responsibility cannot lawfully be assigned to you. You must take reasonable steps to secure your credentials and prevent unauthorized use.

    If you allow employees, contractors, developers, customers, clients, website visitors, or other users to access a service, you are responsible for ensuring that their use complies with this AUP. Resellers are responsible for their downstream users and may not knowingly permit conduct that would be prohibited if performed directly by the reseller.

    You must cooperate reasonably with APNCloud when we investigate an abuse report, security incident, payment-related fraud concern, compromised account, network attack, legal request, or other suspected violation. Failure to provide reasonably requested information or to take corrective action within an appropriate time may result in restriction or suspension where necessary to protect the service or third parties.

    2. Lawful and Honest Use

    APNCloud services may be used only for lawful and legitimate purposes. You may not use a service to commit, facilitate, promote, conceal, or materially support conduct that violates applicable law, court orders, regulatory requirements, or the lawful rights of another person.

    You may not intentionally provide false information to APNCloud, impersonate another person or organization, misrepresent ownership or authorization, or use a service to create a deceptive appearance of affiliation, endorsement, identity, or origin.

    Prohibited conduct includes fraud, theft, extortion, identity theft, account takeover, deliberate deception for financial gain, trafficking in stolen credentials or payment data, sale of unlawfully obtained goods, counterfeit schemes, and services primarily intended to help others evade lawful restrictions.

    A service must not be used to coordinate criminal activity, conceal the proceeds of crime, knowingly facilitate money laundering, or provide infrastructure designed primarily to evade law-enforcement or regulatory action. APNCloud may restrict services where continued operation would expose APNCloud, its customers, or its providers to a material legal or compliance risk.

    3. Fraud, Phishing, Scams, and Deceptive Practices

    You may not use APNCloud services for phishing, credential harvesting, impersonation scams, fake login pages, fraudulent payment pages, deceptive investment or earning schemes, fake support services, fake giveaways, advance-fee fraud, romance scams, business-email compromise, or similar deceptive activity.

    Websites, emails, landing pages, applications, and domains must not be designed to mislead users into believing that they are dealing with a bank, payment provider, government agency, social network, marketplace, cryptocurrency service, cloud provider, hosting company, or other third party when no such authorization exists.

    You may not collect passwords, card details, authentication codes, recovery phrases, private keys, identification documents, or other sensitive information through deceptive means.

    Affiliate marketing, lead generation, comparison pages, review sites, and promotional campaigns must not use fabricated claims, fake endorsements, fake reviews, counterfeit branding, misleading countdowns, deceptive scarcity claims, or other practices intended to manipulate users dishonestly. Marketing claims must be reasonably supportable and must not misrepresent the nature, price, availability, or origin of a product or service.

    APNCloud may act quickly on credible phishing or fraud reports because delay can expose internet users and network reputation to significant harm. A clearly compromised or fraudulent service may be suspended before advance notice when immediate action is reasonably necessary.

    4. Malware, Exploits, and Unauthorized Access

    You may not use APNCloud infrastructure to create, host, distribute, control, sell, or intentionally facilitate malware or malicious code. This includes ransomware, spyware, credential stealers, botnet software, destructive payloads, cryptojacking scripts deployed without consent, malicious browser extensions, backdoors, web shells used for unauthorized access, and software primarily intended to compromise other systems.

    You may not scan, probe, exploit, attack, or attempt to gain unauthorized access to systems, accounts, networks, devices, applications, databases, or services that you do not own or have explicit authorization to test.

    Security research and penetration testing are permitted only where you have lawful authorization from the system owner and the activity does not create unreasonable risk to APNCloud infrastructure, other customers, or third parties. High-volume scanning, exploit automation, denial-of-service testing, or testing that could affect shared infrastructure requires prior written approval from APNCloud.

    You must not knowingly operate command-and-control infrastructure for botnets, malicious remote-access tools, distributed attacks, credential abuse, or compromised devices.

    If APNCloud detects a compromised website or server, we may isolate, suspend, firewall, or otherwise restrict the affected service to prevent further harm. Where practical, we will provide information that can help the customer clean or restore the service.

    5. Network Abuse and Denial-of-Service Activity

    You may not use APNCloud services to launch, coordinate, relay, amplify, sell, facilitate, or knowingly participate in denial-of-service or distributed denial-of-service attacks.

    Prohibited network activity includes packet flooding, reflection or amplification attacks, spoofed traffic, malicious port scanning, repeated brute-force attacks, unauthorized vulnerability scanning, deliberate routing abuse, ARP or DNS poisoning, unauthorized packet interception, and attempts to disrupt or degrade another network or service.

    You may not configure open recursive DNS resolvers, open mail relays, open proxies, or other services in a manner that creates a material abuse risk.

    Traffic generated by a compromised customer server may also be treated as a violation where the customer fails to take reasonable corrective action after notice, or where immediate restriction is required to protect the network.

    APNCloud may apply network filters, rate limits, null routes, temporary blocks, or service isolation to protect infrastructure during an attack or abuse event. Such measures are protective controls and do not imply that every attack can be prevented or absorbed without impact.

    6. Spam, Unsolicited Communications, and Messaging

    APNCloud services must not be used to send spam or unsolicited bulk communications. You may send commercial email only to recipients who have given valid consent, have an appropriate existing relationship where permitted by law, or otherwise may lawfully receive the message.

    You must honor unsubscribe requests promptly and must not use purchased, scraped, harvested, guessed, or unlawfully obtained mailing lists. You must not use forged headers, misleading sender identities, deceptive subject lines, fake reply addresses, or techniques intended primarily to evade spam filters or reputation systems.

    The operation of bulk-email platforms, mailing-list services, transactional email systems, or high-volume messaging infrastructure may be subject to additional technical limits or prior review. A customer may not distribute email across multiple accounts, IP addresses, or domains for the purpose of evading complaints, rate limits, blocklists, or anti-abuse controls.

    You may not use APNCloud services to send abusive SMS, instant messages, push notifications, social messages, or similar communications where such functionality is connected to your hosted application or server.

    Repeated spam complaints, high bounce rates, compromised mailboxes, blocklisting, or evidence of list abuse may result in temporary sending restrictions, IP changes where appropriate, or suspension. Customers are expected to maintain secure mail credentials and reasonable list hygiene.

    7. Intellectual Property and Content Rights

    You must respect copyrights, trademarks, patents, trade secrets, database rights, publicity rights, and other intellectual-property rights.

    You may not knowingly host, distribute, sell, or promote pirated software, unauthorized copyrighted media, counterfeit products, stolen source code, leaked paid content, cracked software, license keys obtained unlawfully, or material that clearly infringes another party’s rights.

    APNCloud may respond to properly submitted intellectual-property complaints and may request information from the customer or complainant before taking action. Where content is clearly unlawful or infringement is established, APNCloud may remove or disable access as appropriate.

    Customers are responsible for ensuring that they have the necessary rights to all content, software, fonts, images, videos, code, databases, trademarks, and other materials uploaded to or distributed through their services.

    A dispute between private parties will not automatically result in removal where the legal position is genuinely uncertain. However, APNCloud may comply with valid court orders, legally binding notices, registrar requirements, or other obligations that apply to the service.

    8. Prohibited or High-Risk Content and Business Activities

    APNCloud services must not be used primarily to offer, promote, distribute, or facilitate categories of activity that are unlawful, exploitative, or create an unacceptable abuse, safety, compliance, or payment risk.

    Prohibited content and services include child sexual abuse material, sexual exploitation, trafficking, non-consensual intimate material, content that sexualizes minors, or services facilitating prostitution or sexual exploitation.

    APNCloud does not permit websites or services primarily dedicated to pornography or sexually explicit commercial content.

    You may not use APNCloud services for illegal gambling, unlicensed betting, fraudulent lotteries, unlawful prize schemes, or gambling services that lack required authorization.

    Services may not be used to sell or facilitate illegal drugs, controlled substances in violation of law, counterfeit medicines, unlawfully supplied prescription drugs, or substances marketed for clearly illegal use.

    You may not use APNCloud infrastructure to sell illegal weapons, explosives, stolen goods, counterfeit goods, or products whose sale is prohibited by applicable law.

    Fraudulent financial services, pyramid or Ponzi schemes, deceptive investment programs, unlicensed money-transmission activity where licensing is legally required, and services designed to steal or misuse payment information are prohibited.

    Content that directly incites credible violence, supports terrorism, coordinates violent criminal activity, or is used to recruit for legally prohibited terrorist organizations is not permitted.

    APNCloud may also refuse or restrict unusually high-risk activities where an upstream provider, registrar, payment partner, network provider, or applicable law prohibits APNCloud from supporting the activity. We will not represent a business as prohibited merely because it is controversial; restrictions will be based on legitimate legal, security, provider, or operational grounds.

    9. Privacy, Personal Data, and Sensitive Information

    Customers are responsible for handling personal data lawfully and securely. You may not collect, sell, disclose, publish, or process personal data through APNCloud services in a manner that is unlawful or materially deceptive.

    You may not publish highly sensitive personal information for the purpose of harassment, intimidation, extortion, identity theft, or facilitating physical harm. This includes doxxing that exposes private contact details, financial data, government identifiers, authentication credentials, or precise private-location information with malicious intent.

    Where your website or application collects personal information, you are responsible for providing appropriate privacy notices, obtaining consent where required, securing the data, and complying with applicable data-protection obligations.

    You must use reasonable safeguards when storing passwords, payment-related data, customer records, backups, identification documents, or other sensitive information. Plain-text storage of credentials or other obviously insecure practices may result in security action if they create a serious risk to users or the network.

    APNCloud’s own handling of customer account information is governed by the APNCloud Privacy Policy.

    10. Harassment, Threats, and Harmful Conduct

    APNCloud services must not be used to make credible threats of violence, conduct targeted harassment campaigns, facilitate stalking, publish private information to enable abuse, or coordinate unlawful intimidation.

    Criticism, satire, political discussion, journalism, and strongly expressed opinions are not prohibited merely because they are offensive or unpopular. APNCloud does not intend this AUP to become a general content-moderation rule for lawful expression.

    Action may be taken where content or activity crosses into credible threats, unlawful harassment, targeted abuse involving private information, incitement of imminent violence, or other conduct that creates a serious and identifiable risk to people or systems.

    Customers who operate forums, communities, social platforms, or user-generated-content services should provide reasonable reporting and moderation mechanisms suitable for the scale and risk of their service.

    11. Resource Usage and Fair Use

    Customers must use hosting resources in a manner appropriate to the service purchased. A plan may include storage, bandwidth, CPU, memory, processes, databases, email, inodes, IP addresses, or other resources.

    You may not deliberately evade resource limits, run workloads designed to monopolize shared infrastructure, or distribute a single workload across multiple accounts to bypass technical restrictions.

    On Shared Hosting and Reseller Hosting, customers must not run persistent high-load processes, uncontrolled background tasks, abusive crawlers, large-scale scraping systems, cryptocurrency mining, high-frequency trading engines, public compute farms, or other workloads that materially degrade service for other users.

    APNCloud may contact a customer whose resource usage is consistently unsuitable for the purchased plan and request optimization, an upgrade, workload reduction, or migration to a more appropriate service.

    Temporary resource spikes are expected in normal web hosting. Enforcement will focus on sustained or abusive use, attempts to evade limits, or activity that materially harms service stability.

    12. Unmetered Bandwidth

    Where a plan is advertised with “Unmetered Bandwidth,” APNCloud does not impose a fixed monthly data-transfer quota solely for ordinary use of that bandwidth feature. Unmetered does not mean infinite capacity, unlimited port speed, guaranteed throughput at all times, or permission to use the service for any workload.

    Unmetered bandwidth remains subject to the network port assigned to the service, available upstream capacity, hardware capacity, fair use, security controls, and this AUP.

    Customers may not use an unmetered service primarily as a public download mirror, mass file-distribution node, anonymous file dump, backup repository for unrelated systems, abusive streaming platform, open proxy, traffic relay, or other bandwidth-intensive service that is disproportionate to the hosting plan unless APNCloud has explicitly approved that use.

    Where traffic is legitimate but unusually heavy, APNCloud may work with the customer to identify a more suitable plan, dedicated connection, server, rate limit, or commercial arrangement. We will not describe ordinary legitimate traffic as abuse simply because a website becomes popular.

    13. Storage, File Hosting, Backups, and Media Distribution

    Shared and Reseller Hosting storage is intended primarily for website files, application data, databases, email, logs, and related hosting content.

    Unless a plan expressly permits it, Shared or Reseller Hosting may not be used primarily as a general-purpose cloud drive, personal archive, remote backup target, software mirror, video archive, media dump, or file-sharing repository unrelated to the hosted website.

    Customers must not store unlawful copies of copyrighted media, stolen databases, credential collections, malware repositories, or data obtained through unauthorized access.

    Backups provided by APNCloud are intended as an additional recovery measure. Customers remain responsible for maintaining independent copies of important data where appropriate. The presence of a backup feature does not authorize a customer to use hosting storage as an unrelated backup service.

    VPS and Dedicated Server customers generally have broader flexibility to use their allocated storage, but all use remains subject to law, this AUP, service specifications, and any applicable provider limits.

    14. VPS and Dedicated Server Use

    VPS and Dedicated Server customers receive greater control and therefore carry greater responsibility for security and network behavior.

    You must maintain secure administrator credentials, apply reasonable security updates, remove compromised software, and ensure that services exposed to the internet are configured responsibly.

    Open proxies, Tor exit nodes, public VPN gateways, traffic-relay services, mass scanning infrastructure, and similar high-abuse-risk network services are not permitted unless APNCloud has expressly approved the use in writing. Even with approval, the customer remains responsible for complaints, lawful use, and network reputation.

    Cryptocurrency mining, sustained proof-of-work workloads, or other workloads designed to consume continuous maximum CPU or GPU capacity are prohibited unless the applicable product is explicitly sold for that purpose or APNCloud has approved the workload.

    Customers may operate development environments, APIs, game servers, databases, business applications, websites, and other lawful workloads appropriate to their plan, provided the activity does not violate this AUP or materially threaten network stability.

    15. Reseller Hosting Responsibilities

    Reseller customers may create and manage hosting accounts for their own clients within the limits of the purchased reseller plan.

    A reseller must maintain reasonable controls to prevent spam, phishing, malware, copyright abuse, fraud, and other violations by downstream customers. The reseller should respond promptly when APNCloud forwards an abuse report relating to one of the reseller’s sub-accounts.

    Resellers may use their own brand and private nameservers where supported, but may not misrepresent ownership of APNCloud infrastructure in a way that creates fraud or unlawful deception.

    A reseller is responsible for its own commercial relationship with its end users, including its own pricing, customer support, billing, and refund obligations unless APNCloud has expressly agreed otherwise.

    APNCloud may suspend only the affected sub-account where practical. However, if abuse is widespread, repeatedly ignored, intentionally enabled, or creates an urgent network or legal risk, APNCloud may restrict or suspend the reseller service as a whole.

    Resellers must not create accounts primarily to evade limits that would otherwise apply to their own use.

    16. Email Accounts and Mail Server Reputation

    Customers must protect email credentials, use strong passwords, and take reasonable action if a mailbox is compromised.

    Mail servers must not be configured as open relays. Customers must not deliberately rotate domains, mailboxes, or IP addresses to avoid spam complaints, provider restrictions, or blocklists.

    If a website form, script, plugin, or compromised account begins sending abusive mail, the customer must remediate the source promptly. APNCloud may temporarily limit outbound mail where necessary to protect IP reputation and delivery for other customers.

    Customers operating legitimate newsletters should maintain evidence of consent where appropriate, provide a functioning unsubscribe mechanism, remove invalid addresses, and use reasonable sending practices.

    APNCloud does not guarantee that every recipient network will accept email. Deliverability depends on content, reputation, authentication, list quality, recipient policies, and factors outside APNCloud’s control.

    17. Domains, DNS, and Naming Services

    Domains and DNS services must not be used for phishing, malware distribution, command-and-control activity, fraudulent redirects, deceptive impersonation, or other prohibited conduct.

    Customers must provide accurate domain-registration information where required and comply with applicable registrar and registry rules.

    A domain that resolves to infrastructure outside APNCloud may still be subject to action where APNCloud is providing the registration or DNS service and continued support would violate law, registrar rules, or this AUP.

    Customers must not deliberately configure DNS records to facilitate spam, evade abuse controls, or conceal malicious infrastructure.

    APNCloud may place a domain on hold, suspend DNS service, or take other action where required by a registrar, registry, court, applicable law, or a serious and verified abuse event, subject to the rights and procedures available for the relevant domain.

    18. IP Addresses and Reputation

    IP addresses assigned with APNCloud services remain subject to technical availability and provider policies.

    You must not use assigned IP addresses for spam, phishing, attacks, fraud, malicious scanning, unauthorized access, or other activity likely to cause blocklisting or reputational harm.

    Customers may not falsify reverse DNS, sender identity, or network information for deceptive purposes.

    If an IP address becomes listed because of customer activity, the customer must cooperate in stopping the underlying abuse before requesting delisting assistance. APNCloud is not required to repeatedly replace IP addresses where the customer’s own activity is causing the reputation problem.

    APNCloud may change, filter, or withdraw an IP assignment where reasonably necessary for abuse prevention, routing, provider requirements, security, or network maintenance.

    19. Circumvention and Evasion

    You may not attempt to bypass APNCloud security systems, account restrictions, suspension controls, resource limits, rate limits, email limits, fraud controls, payment controls, or abuse enforcement.

    Creating additional accounts, using false identities, changing domains, moving content between services, rotating IP addresses, or using resellers to continue substantially the same prohibited activity after suspension may be treated as circumvention.

    You may not interfere with logging, monitoring, authentication, or security mechanisms used to protect APNCloud infrastructure.

    Customers are free to use legitimate privacy and security tools. This section is directed at deliberate evasion of service restrictions or abuse controls, not ordinary security practices.

    20. Vulnerability Disclosure and Security Testing

    If you discover a vulnerability affecting APNCloud, please report it responsibly through APNCloud Support or the official contact method published on the website.

    Do not exploit a vulnerability beyond what is reasonably necessary to demonstrate the issue. Do not access, alter, delete, download, or disclose other customers’ data. Do not disrupt production services or conduct denial-of-service testing.

    APNCloud values good-faith security reporting. Responsible research conducted within lawful boundaries will not be treated as malicious merely because it identifies a technical flaw.

    Testing third-party systems hosted on APNCloud still requires authorization from the relevant system owner.

    21. Abuse Reports and Complaints

    Anyone may report suspected abuse through the APNCloud Report Abuse page, support channel, or the contact information published on the APNCloud website.

    A useful abuse report should include the affected domain, IP address, URL, relevant timestamps, a description of the issue, and supporting evidence where available.

    APNCloud may request additional information where necessary to distinguish a genuine violation from an unsupported allegation, private dispute, or mistaken report.

    We may share relevant portions of a complaint with the affected customer where appropriate so that the customer can investigate and respond. Sensitive information may be withheld where disclosure would create a security, privacy, or legal risk.

    Submitting false, malicious, or knowingly misleading abuse reports is itself unacceptable and may be disregarded or restricted.

    22. Investigation and Enforcement

    APNCloud may investigate suspected violations using information reasonably available to us, including network logs, account information, technical indicators, abuse reports, security alerts, provider notices, and customer responses.

    Depending on severity, APNCloud may take one or more actions: issue a warning; request corrective action; disable a specific file, mailbox, process, port, domain, or sub-account; apply a temporary technical restriction; suspend a service; terminate a service; refuse new orders; or report conduct to an appropriate authority where legally required or necessary to address serious criminal activity.

    Where practical and safe, APNCloud will normally give the customer an opportunity to correct non-urgent violations. Immediate action may be taken without prior notice for phishing, malware, active attacks, serious fraud, child sexual abuse material, imminent threats, compromised systems causing harm, or other situations requiring urgent containment.

    Enforcement decisions may consider intent, impact, repeated behavior, previous warnings, customer cooperation, technical risk, and whether the issue resulted from a compromise rather than deliberate conduct.

    Suspension for abuse does not automatically create a right to a refund. Refund eligibility is governed by the APNCloud Refund Policy, Terms of Service, and applicable law.

    23. Restoration After Suspension

    Where a service has been suspended for a correctable violation, APNCloud may require the customer to explain the remediation steps taken before restoration.

    Examples may include removing malicious files, updating vulnerable software, resetting compromised passwords, disabling an abusive user, securing a mail form, closing an open proxy, cleaning malware, or providing evidence of lawful authorization.

    APNCloud may require a customer to migrate to a more appropriate plan if the underlying issue is sustained resource use rather than prohibited conduct.

    Restoration is not guaranteed where the violation was deliberate, repeated, fraudulent, illegal, or created a serious risk to APNCloud or third parties.

    24. Relationship to Other Policies

    This AUP must be read together with the APNCloud Terms of Service, Privacy Policy, Refund Policy, Billing & Renewal Policy, Service Level Agreement, Domain Registration Policy, and any service-specific terms that apply to the customer’s order.

    If a specific product description imposes a stricter technical limit than this AUP, the product limit still applies. If this AUP prohibits an activity, purchasing a larger plan does not make that activity permitted unless APNCloud expressly approves it and the activity is lawful.

    Nothing in this AUP requires APNCloud to host content or activity where doing so would violate applicable law, a binding legal order, registrar or registry rules, or the contractual requirements of infrastructure necessary to provide the service.

    25. Changes to This Acceptable Use Policy

    APNCloud may update this AUP to address new technologies, abuse patterns, security threats, legal requirements, supplier obligations, or changes to our services.

    Material changes will be published on the APNCloud website with an updated effective date. Where required by applicable law or where a change materially affects an existing paid service, APNCloud will provide additional notice as appropriate.
