    Policy status: This Abuse Policy forms part of APNCloud's contractual policies and should be read together with the Terms of Service and Acceptable Use Policy.

    1. Purpose and Scope

    This Abuse Policy explains how APNCloud responds to misuse of its hosting, domain, server, network, email, software, and related services. It is designed to protect customers, end users, third parties, internet infrastructure, payment partners, service providers, and APNCloud systems from unlawful, harmful, deceptive, disruptive, or abusive activity.

    This Policy applies to every APNCloud customer, account holder, reseller, administrator, authorized user, sub-user, and any person who uses or benefits from an APNCloud service. It also applies to content, traffic, applications, websites, domains, email, files, scripts, software, virtual machines, dedicated servers, reseller sub-accounts, and other resources hosted, transmitted, managed, or routed through APNCloud.

    This Policy forms part of the APNCloud Terms of Service and should be read together with the Acceptable Use Policy, Privacy Policy, Service Level Agreement, Refund Policy, Billing and Renewal Policy, Domain Registration Policy, and any service-specific terms. If a service has additional abuse or security rules, those rules apply in addition to this Policy.

    APNCloud may investigate suspected abuse and may take proportionate action when reasonably necessary to protect customers, infrastructure, third parties, or the public. Actions may include requesting information, issuing a warning, limiting a specific function, disabling affected content, suspending a service, terminating an account, preserving relevant records, or referring a matter to an upstream provider or competent authority where required by law.

    2. Zero Tolerance for Serious Abuse

    APNCloud does not permit services to be used for serious unlawful or malicious conduct. Examples include operating or distributing malware, phishing, credential theft, botnets, ransomware, unauthorized access tools used for attacks, denial-of-service attacks, deliberate network disruption, fraud schemes, stolen payment activity, or content that is prohibited by applicable law.

    Where APNCloud reasonably believes that continued operation creates an immediate and significant risk to other users, systems, payment partners, network providers, or the public, APNCloud may act without advance notice. Immediate action is intended to contain harm, not to punish a customer before facts are reviewed. Where appropriate and legally permitted, APNCloud may later provide the customer with information about the reason for the action and an opportunity to respond.

    Nothing in this Policy requires APNCloud to host, transmit, or continue providing a service that would expose APNCloud or its providers to unlawful activity, material security risk, regulatory violation, sanctions risk, or serious reputational harm.

    3. Malware, Phishing, Credential Theft, and Fraud

    Customers must not use APNCloud services to create, host, distribute, redirect to, facilitate, or knowingly support malware, phishing pages, deceptive login pages, credential harvesting, ransomware, malicious scripts, unauthorized browser injections, malicious downloads, or other content intended to compromise devices, accounts, credentials, financial information, or networks.

    A website or application must not imitate another organization in a way intended to deceive users into submitting passwords, payment information, recovery codes, account credentials, or other sensitive information. Legitimate testing, internal security research, or authorized demonstrations must be clearly controlled and must not target systems or persons without permission.

    Customers must not use APNCloud services to conduct payment fraud, use stolen payment credentials, deliberately misrepresent identity or business information, create accounts to evade a prior fraud-related restriction, abuse promotional credits, manufacture false transactions, or misuse chargeback procedures. APNCloud may request reasonable payment or identity verification where fraud indicators are present. A failure to complete required verification may delay activation or result in cancellation where the risk cannot reasonably be resolved.

    If compromised customer content is discovered, APNCloud may temporarily isolate or disable the affected service while the customer removes malicious files, changes credentials, updates software, or completes other remediation steps. Customers are expected to cooperate promptly with reasonable security requests.

    4. Unauthorized Access, Hacking, Scanning, and Exploitation

    Customers must not use APNCloud infrastructure to gain or attempt to gain unauthorized access to any computer, network, account, service, database, device, or application. This includes password attacks, credential stuffing, unauthorized vulnerability exploitation, malicious privilege escalation, unauthorized remote access, or attempts to bypass authentication or access controls.

    Port scanning, vulnerability scanning, penetration testing, load testing, exploit testing, and similar activities may only be performed against systems that the customer owns or has explicit authorization to test. Such activity must be conducted in a controlled manner and must not create excessive traffic, interfere with third-party systems, or trigger abuse against unrelated networks.

    APNCloud may investigate outbound patterns that indicate compromised servers, automated attack activity, suspicious scanning, or brute-force behavior. A customer who operates legitimate security tools is responsible for configuring them so they do not target third parties without permission.

    Repeated security incidents caused by unpatched software, weak credentials, abandoned applications, or ignored compromise notices may result in restrictions where the customer fails to take reasonable corrective action.

    5. Denial-of-Service, Network Abuse, and Disruption

    Customers must not launch, coordinate, facilitate, sell, or knowingly participate in distributed denial-of-service attacks, denial-of-service attacks, packet flooding, amplification attacks, reflection attacks, malicious traffic generation, or other activity intended to overload or disrupt a network, service, application, or device.

    Customers must not intentionally interfere with routing, DNS, network monitoring, security controls, IP reputation systems, or technical mechanisms used to maintain service stability. Spoofed traffic, forged source addresses, malicious tunneling, unauthorized route advertisements, or other deceptive network behavior are prohibited.

    If an APNCloud service is targeted by an external attack, APNCloud may apply filtering, rate limits, null routing, temporary isolation, IP changes, or other mitigation measures to protect the wider platform. Such measures may temporarily affect the attacked service. These actions are considered protective network management and are subject to the applicable Service Level Agreement.

    A customer operating high-traffic or security-sensitive services must ensure that the purchased plan is technically suitable for the expected use. Unmetered bandwidth does not authorize malicious, artificial, or intentionally disruptive traffic.

    6. Spam, Unsolicited Messaging, and Email Abuse

    APNCloud services must not be used to send spam, unsolicited bulk email, deceptive commercial messages, phishing email, mass messages sent without required consent, or email intended to evade anti-spam systems.

    Customers who send legitimate marketing or transactional email are responsible for complying with applicable consent, identification, unsubscribe, privacy, and anti-spam requirements. Mailing lists should be based on valid permission or another lawful basis where applicable. Purchased, harvested, scraped, or unlawfully obtained recipient lists must not be used through APNCloud services.

    Customers must not operate open mail relays, intentionally falsify message headers, use misleading sender identities, rotate domains or IP addresses to evade reputation controls, or continue sending to recipients who have validly opted out where an opt-out is required.

    APNCloud may investigate complaints, bounce patterns, blocklist listings, abnormal sending volume, or other indicators of email abuse. Where a customer causes significant IP reputation damage, APNCloud may limit outbound mail, require remediation, suspend the affected account, or charge reasonable remediation costs where expressly permitted by the applicable service agreement.

    Resellers are responsible for monitoring email abuse by their own hosting customers and must respond promptly when APNCloud forwards a valid abuse complaint.

    7. Prohibited Content and Illegal Activity

    Customers must not use APNCloud services to store, publish, transmit, promote, or facilitate content or activity that is unlawful in the applicable jurisdiction or that APNCloud is legally required to restrict.

    Prohibited activity includes fraud, identity theft, unlawful sale of regulated goods or services, unlawful gambling operations, trafficking, serious financial crime, sanctions evasion, and other conduct prohibited by applicable law. Content involving child sexual abuse material is strictly prohibited and may be reported to appropriate authorities or specialist reporting bodies as required by law.

    APNCloud does not make legal judgments merely because content is controversial, unpopular, critical, or offensive. However, APNCloud may act where content or activity violates law, a binding legal order, the rights of others, an upstream provider's enforceable requirements, or a specific APNCloud policy.

    Customers are responsible for understanding the laws that apply to their websites, applications, customers, products, and activities. APNCloud's acceptance of an order does not constitute legal approval of the customer's business or content.

    8. Intellectual Property and Copyright Complaints

    Customers must not knowingly use APNCloud services to infringe copyright, trademark, patent, trade secret, or other intellectual property rights.

    APNCloud may review properly submitted intellectual property complaints that identify the protected work or right, the allegedly infringing material, the relevant URL or service, the complainant's contact information, and a good-faith basis for the complaint. APNCloud may request additional information where a complaint is incomplete or unclear.

    Depending on the circumstances, APNCloud may forward a complaint to the customer, request removal or clarification, temporarily restrict specific material, or take other proportionate action. APNCloud may decline to act on vague, abusive, fraudulent, or unsupported complaints.

    Customers who believe a complaint is mistaken should respond with relevant evidence and a clear explanation. APNCloud may restore access where appropriate if the issue is resolved, the complaint is withdrawn, or sufficient information shows that continued restriction is not justified.

    Repeat or deliberate infringement may result in stronger account action where required by law or reasonably necessary to protect APNCloud and third parties.

    9. Domain Name Abuse

    Domains registered, transferred, managed, or used with APNCloud services must not be used for phishing, malware distribution, fraud, deceptive impersonation, command-and-control activity, spam campaigns, unlawful content, or other prohibited abuse.

    Domain-related services may also be subject to rules imposed by registries, registrars, ICANN policies where applicable, and other domain authorities. APNCloud may be required to relay abuse notices, verify contact information, suspend DNS or domain services, or cooperate with a registrar or registry in accordance with applicable rules.

    APNCloud cannot guarantee that a domain will remain active when a registry, registrar, court, authority, or applicable policy requires suspension, transfer, lock, or other action.

    Customers must maintain accurate domain contact information and must not use privacy or proxy services to conceal unlawful activity or frustrate legitimate abuse investigation.

    10. Resource Abuse and Fair Use

    Hosting plans are designed for legitimate websites, applications, email, databases, development, business services, and other uses appropriate to the purchased product. Customers must not intentionally consume resources in a manner that materially degrades service for others or creates unreasonable infrastructure risk.

    Resource abuse may include sustained excessive CPU use, memory exhaustion, abusive process creation, uncontrolled database queries, excessive disk I/O, intentional inode exhaustion, abusive backup generation, mass temporary file creation, or traffic patterns inconsistent with the intended service.

    Where a plan includes unmetered bandwidth, unmetered means that APNCloud does not apply a fixed monthly transfer quota solely for normal use of that resource. It does not mean infinite capacity or exemption from fair-use, security, network, or technical restrictions.

    Shared and reseller hosting must not be used primarily as a public file dump, mass backup repository, abusive video distribution platform, open proxy, traffic relay, or other storage or network service that is materially inconsistent with the hosting plan unless APNCloud has expressly approved the use.

    APNCloud will normally attempt to contact a customer about non-urgent resource problems and may recommend optimization or an upgrade. In urgent cases, temporary limits may be applied to protect platform stability.

    11. Proxy, VPN, Tunneling, and Relay Services

    Customers must not operate open proxies, open relays, anonymous traffic gateways, public tunneling services, or similar systems on plans where such activity is prohibited or technically unsuitable.

    Where a VPS or dedicated server plan allows a customer to operate a lawful private VPN, proxy, or tunneling service, the customer remains responsible for user activity, abuse handling, applicable laws, IP reputation, and compliance with this Policy. APNCloud may prohibit or restrict a particular configuration if it repeatedly generates abuse, blocklist listings, attacks, or legal complaints.

    No APNCloud service may be used to conceal the origin of malicious activity, bypass sanctions or legal restrictions, facilitate credential theft, or evade a prior APNCloud suspension.

    12. Cryptocurrency Mining and High-Intensity Computing

    Cryptocurrency mining and other sustained high-intensity computing workloads may be restricted on shared hosting, reseller hosting, or other services not designed for continuous heavy CPU, GPU, power, or I/O consumption.

    Customers must not deploy mining software, computational workloads, or distributed jobs in a manner that degrades other services or violates the specifications of the purchased plan. VPS or dedicated server use may be subject to separate product limits, data-center rules, power limits, or prior approval.

    Malicious cryptomining installed through account compromise is treated as a security incident and may result in immediate isolation of the affected service until remediation is completed.

    13. Reseller Responsibilities

    A reseller is responsible for the conduct of websites, accounts, and end users created under the reseller service. Resellers must maintain reasonable contact information for their customers, respond to abuse complaints, and take action when APNCloud notifies them of verified or credible abuse.

    A reseller may create its own customer terms, but those terms must not authorize activity prohibited by APNCloud. Resellers must not market their service in a way that suggests that spam, phishing, copyright infringement, malware, unrestricted anonymous abuse, or other prohibited activity is allowed.

    APNCloud may contact a reseller rather than the reseller's end user. If the reseller fails to respond within a reasonable period, or if urgent action is needed, APNCloud may directly suspend or restrict the affected sub-account or service.

    Repeated failure to manage abuse may result in suspension or termination of the reseller account.

    14. Abuse Reports

    Anyone may report suspected abuse involving APNCloud services through the APNCloud Report Abuse page or another official support channel published on the APNCloud website.

    A useful abuse report should include as much relevant information as reasonably available, such as the affected domain, hostname, IP address, URL, date and time, type of abuse, supporting logs or screenshots, message headers for email complaints, and contact information for follow-up.

    Complainants should not send unnecessary sensitive personal data, passwords, full payment card numbers, or unrelated confidential information. APNCloud may request clarification if a report is incomplete.

    Submitting a report does not guarantee immediate suspension. APNCloud will assess the available evidence, seriousness, urgency, applicable law, customer history, technical context, risk to third parties, and whether less disruptive remediation is appropriate.

    Knowingly false, malicious, fraudulent, or abusive reports may be rejected.

    15. Investigation and Evidence

    APNCloud may review service logs, account records, traffic indicators, abuse reports, support history, IP reputation information, security alerts, and other data reasonably available to investigate suspected abuse.

    APNCloud does not promise to continuously monitor all customer content or traffic. The absence of prior action does not mean that particular activity is permitted.

    Where appropriate, APNCloud may ask the customer to explain the activity, remove content, patch software, change passwords, provide proof of authorization, stop a campaign, or take another corrective step. Customers must not intentionally delete or alter evidence after being notified of a serious security or abuse investigation where preservation is required by law or reasonably requested for incident resolution.

    APNCloud may share relevant information with upstream providers, registrars, security partners, payment processors, professional advisers, insurers, or authorities when reasonably necessary and legally permitted. Personal data will be handled in accordance with the Privacy Policy and applicable law.

    16. Enforcement Actions

    APNCloud aims to use proportionate enforcement. Depending on the severity and history of the issue, APNCloud may take one or more of the following actions:

    • issue an advisory or warning;
    • request customer remediation within a stated period;
    • disable a compromised password, mailbox, script, website, domain, or sub-account;
    • restrict outbound email or network traffic;
    • temporarily rate-limit or isolate a service;
    • remove or disable access to specific prohibited material where appropriate;
    • suspend a service;
    • suspend an account;
    • terminate a service or account for serious or repeated abuse;
    • refuse new orders from a person or organization associated with serious abuse or fraud;
    • preserve relevant records;
    • notify or cooperate with an upstream provider, registrar, registry, payment provider, or authority where required or reasonably necessary.

    Immediate suspension or termination may occur where APNCloud reasonably believes there is serious fraud, active malware, phishing, an ongoing attack, child sexual abuse material, significant payment abuse, substantial network harm, a binding legal requirement, or another urgent risk.

    Where possible and appropriate, APNCloud will limit action to the affected service rather than unrelated services.

    17. Suspension, Restoration, and Remediation

    A suspended service may be restored when APNCloud is reasonably satisfied that the abuse has stopped, the underlying cause has been addressed, required verification has been completed, and continued operation does not create an unacceptable risk.

    Restoration may require the customer to remove malicious content, update software, reset passwords, secure forms, disable compromised accounts, correct DNS, close an open relay, stop abusive messaging, or provide evidence of authorization.

    APNCloud does not guarantee that all data will remain available after termination, expiration, or prolonged suspension. Customers should maintain independent backups in accordance with the Terms of Service.

    Where abuse has caused exceptional third-party charges, IP replacement costs, emergency administration work, or provider penalties, APNCloud may seek reasonable recovery of those costs only where permitted by the applicable agreement and law.

    18. Appeals and Customer Responses

    A customer who believes an abuse action was taken in error may contact APNCloud Support and provide a concise explanation and relevant evidence.

    An appeal should identify the affected service, explain why the activity is legitimate or why the issue has been resolved, and include any technical or legal information needed to review the matter.

    APNCloud may maintain a restriction while an appeal is reviewed where restoring the service would create a material risk. APNCloud will make a reasonable effort to review good-faith appeals promptly, taking account of severity, available evidence, provider requirements, and legal obligations.

    An appeal does not prevent APNCloud from complying with a valid legal order, registrar requirement, network-provider instruction, or other binding obligation.

    19. Law Enforcement and Legal Requests

    APNCloud may respond to valid legal process, court orders, regulatory requirements, law-enforcement requests, or other legally binding demands in accordance with applicable law.

    APNCloud may preserve information when legally required or when reasonably necessary to protect rights, investigate serious abuse, prevent fraud, or respond to a credible legal claim.

    APNCloud does not disclose customer information merely because a third party asks for it. Requests for customer data are evaluated in light of applicable law, the Privacy Policy, and the nature of the request.

    Where legally permitted, APNCloud may direct private disputes to the appropriate legal process rather than deciding contested facts between third parties.

    20. Payment and Account Abuse

    APNCloud services must not be purchased or used with stolen payment methods, unauthorized accounts, false billing information, fabricated identities, or other fraudulent payment techniques.

    Customers must not intentionally initiate chargebacks for transactions they know are valid in order to obtain services without payment. This does not limit a customer's lawful right to dispute an unauthorized or genuinely incorrect charge.

    APNCloud may cooperate with payment processors and financial-service providers in investigating fraud, chargeback abuse, unauthorized transactions, or other payment-related misconduct. Services connected to a high-confidence fraud event may be suspended while the matter is reviewed.

    Use of a payment method such as a card, PayPal, Paddle, Skrill, Wise, bank transfer, or another provider does not change the customer's obligation to comply with this Abuse Policy. Payment availability may vary, and the rules of the relevant payment provider may also apply.

    21. Privacy and Confidentiality of Abuse Reports

    APNCloud will handle abuse reports and investigation data with reasonable care. Information may be shared with the affected customer when necessary to investigate or resolve a complaint, but APNCloud may withhold information where disclosure would create a security risk, violate law, expose confidential sources, or interfere with an investigation.

    Complainants should assume that non-confidential parts of a complaint may be shared with the customer so the customer can respond. A complainant who has a legitimate safety or confidentiality concern should identify it when submitting the report.

    Personal data collected through abuse reporting is processed for legitimate security, legal, fraud-prevention, service-protection, and dispute-handling purposes as described in the APNCloud Privacy Policy.

    22. Repeat Abuse and Evasion

    APNCloud may take stronger action where a customer repeatedly violates this Policy, ignores reasonable remediation requests, creates new accounts to bypass restrictions, moves abusive activity between sub-accounts, or deliberately changes domains, IP addresses, identities, or payment methods to continue prohibited conduct.

    Account creation intended to evade a prior termination for serious abuse or fraud may itself be grounds for refusal or termination.

    APNCloud may consider related accounts, common control, shared billing information, technical indicators, and other reasonable evidence when assessing deliberate evasion, while taking care not to penalize unrelated customers solely because they share infrastructure or a network.

    23. No Waiver and No Duty to Monitor

    APNCloud's failure to enforce a provision in one instance does not waive the right to enforce it later. Different incidents may require different responses based on severity, evidence, risk, customer history, legal requirements, and technical circumstances.

    APNCloud is not required to proactively monitor every file, message, website, domain, or network packet hosted through its services. Customers remain responsible for their own content, users, applications, and security.

    Nothing in this Policy creates a guarantee that APNCloud can prevent all abuse, cyberattacks, fraud, spam, malware, or unlawful activity.

    24. Changes to this Policy

    APNCloud may update this Abuse Policy to reflect changes in services, technology, security practices, provider requirements, legal obligations, or abuse trends.

    Material changes will be published on the APNCloud website and will take effect in accordance with the Terms of Service and applicable law. Customers should review the current version periodically.

    Continued use of APNCloud services after an updated Policy becomes effective constitutes acceptance to the extent permitted by applicable law.

    25. Contact and Abuse Reporting

    Abuse involving APNCloud services should be reported through the official Report Abuse page on the APNCloud website or through the official support contact published by APNCloud.

    When reporting urgent security abuse, include the affected domain or IP address, a clear description of the issue, relevant timestamps, and supporting evidence. Do not include passwords, full payment card numbers, or unrelated sensitive information.

    APNCloud will prioritize reports according to severity and risk. Reports involving active phishing, malware, attacks, serious fraud, or immediate threats to infrastructure may receive urgent handling.
